Tensing Retrial Set For May 25, 2017

Update 12/14/16: Judge Leslie Ghiz is barring attorneys from discussing the case. In issuing the gag order Wednesday Ghiz writes, "It's intended to prevent media coverage of statements that might unfairly influence the potential jury pool and outcome of the case."

Original Post: Former UC Police Officer Ray Tensing is scheduled to stand trial May 25, 2017. He's charged with murder and voluntary manslaughter in the shooting death of Sam DuBose during a 2015 traffic stop. His first trial ended in a hung jury Nov. 12.

Hamilton County Judge Leslie Ghiz says she does not plan on moving the retrial out of Hamilton County. "We are anticipating that the trial is going to take place in Hamilton County," says Ghiz. "It's the objective of this court to make that it does and to make sure that we are able to seat a jury here and proceed here."

When announcing his plans to retry Tensing, Prosecutor Joe Deters said he would ask for a change of venue. Tensing's attorney Stew Mathews is opposing that idea.

Mathews says he's starting over from scratch. However, other than saying he'll again ask for DuBose's medical records to be admitted into evidence, he isn't giving much away.

"I think any time you do things twice, you do things differently," he says.

The next meeting between the judge and attorneys is Jan. 23, 2017.
